شَرْحُ رِيَاضِ الصَّالِحِينَ مِنْ كَلَامِ سَيِّدِ الْمُرْسَلِينَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. نَقُولُ: لَا، لَا يَرُدُّهُ عَلَيْهِمْ؛ لِأَنَّهُمْ قَدْ أَخَذُوا عِوَضًا، فَلَا يُجْمَعُ لَهُمْ بَيْنَ الْعِوَضِ وَالْمُعَوَّضِ، وَلَكِنْ يَتَصَدَّقُ بِهِ؛ تَخَلُّصًا مِنْهُ، أَوْ يَجْعَلُهُ فِي بَيْتِ الْمَالِ، إِنْ كَانَ هُنَاكَ بَيْتُ مَالٍ. وَكَذَلِكَ يُقَالُ فِيمَنْ بَاعَ كَلْبًا - سَوَاءٌ كَانَ كَلْبَ صَيْدٍ أَوْ حَرْثٍ أَوْ مَاشِيَةٍ - وَأَخَذَ ثَمَنَهُ، ثُمَّ هَدَاهُ اللَّهُ، وَتَابَ، نَقُولُ: لَا تَرُدَّ هَذَا الثَّمَنَ إِلَى الَّذِي أَخَذَ الْكَلْبَ، فَتَجْمَعُ لَهُ بَيْنَ الْعِوَضِ وَالْمُعَوَّضِ، وَلَكِنْ تَصَدَّقْ بِهِ؛ تَخَلُّصًا مِنْهُ، أَوِ اجْعَلْهُ فِي بَيْتِ الْمَالِ. وَكَذَلِكَ يُقَالُ فِي مَهْرِ الْبَغِيِّ، إِذَا تَابَتِ الْمَرْأَةُ إِلَى اللَّهِ وَرَجَعَتْ لَا تَرُدُّ مَا أَخَذَتْ مِنَ الزَّانِي، بَلْ تَجْعَلُهُ فِي بَيْتِ الْمَالِ، أَوْ تَتَصَدَّقُ بِهِ، أَوْ تُنْفِقُهُ فِي أَيِّ سَبِيلٍ مِنْ سُبُلِ الْخَيْرِ.

نَقُولُ: لَا، لَا يَرُدُّهُ عَلَيْهِمْ؛ لِأَنَّهُمْ قَدْ أَخَذُوا عِوَضًا، فَلَا يُجْمَعُ لَهُمْ بَيْنَ الْعِوَضِ وَالْمُعَوَّضِ، وَلَكِنْ يَتَصَدَّقُ بِهِ؛ تَخَلُّصًا مِنْهُ، أَوْ يَجْعَلُهُ فِي بَيْتِ الْمَالِ، إِنْ كَانَ هُنَاكَ بَيْتُ مَالٍ.
We say: No, he should not return it to them, for they have already received compensation. It is not right to allow them both the payment and the item itself. Instead, he should give it away as charity to be rid of it, or deposit it into the public treasury, provided one exists.
وَكَذَلِكَ يُقَالُ فِيمَنْ بَاعَ كَلْبًا - سَوَاءٌ كَانَ كَلْبَ صَيْدٍ أَوْ حَرْثٍ أَوْ مَاشِيَةٍ - وَأَخَذَ ثَمَنَهُ، ثُمَّ هَدَاهُ اللَّهُ، وَتَابَ، نَقُولُ: لَا تَرُدَّ هَذَا الثَّمَنَ إِلَى الَّذِي أَخَذَ الْكَلْبَ، فَتَجْمَعُ لَهُ بَيْنَ الْعِوَضِ وَالْمُعَوَّضِ، وَلَكِنْ تَصَدَّقْ بِهِ؛ تَخَلُّصًا مِنْهُ، أَوِ اجْعَلْهُ فِي بَيْتِ الْمَالِ.
The same applies to someone who sells a dog—whether for hunting, guarding crops, or herding livestock—and accepts payment, only for Allah to guide him to repentance later. We say: Do not return the money to the buyer, as that would grant him both the dog and the price. Give the money away as charity to be rid of it, or deposit it into the public treasury.
وَكَذَلِكَ يُقَالُ فِي مَهْرِ الْبَغِيِّ، إِذَا تَابَتِ الْمَرْأَةُ إِلَى اللَّهِ وَرَجَعَتْ لَا تَرُدُّ مَا أَخَذَتْ مِنَ الزَّانِي، بَلْ تَجْعَلُهُ فِي بَيْتِ الْمَالِ، أَوْ تَتَصَدَّقُ بِهِ، أَوْ تُنْفِقُهُ فِي أَيِّ سَبِيلٍ مِنْ سُبُلِ الْخَيْرِ.
This also applies to the earnings of a prostitute. If she repents to Allah and turns away from her past, she should not return the money to the adulterer. Instead, she should deposit it in the public treasury, give it to charity, or spend it on any righteous cause.
