الناقِضُ الرَّابِعُ. فَأَجَابَ: قَرَائِنُ الْأَحْوَالِ تَقْتَضِي أَنَّهُمْ يَسْتَجِيزُونَهُ، لَكِنَّ الْحُكْمَ بِالرِّدَّةِ أَمْرٌ وَرَاءَ ذَلِكَ. قَالَ السَّائِلُ: طَيِّبٌ مَسْأَلَةٌ أُخْرَى، إِذَا لَمْ نَحْكُم عَلَيْهِم بِالْكُفْرِ أَلَا يَجُوزُ أَن نَعْتَبِرَ أَنَّ هَذَا مِنَ الْكُفْرِ الَّذِي يُرَى (إِلَّا أَن تَرَوْا كُفْرًا بَوَاحًا)، وَلِذَلِكَ يَقْتَضِي الْخُرُوجَ عَلَيْهِ مَا حَكَمْنَا عَلَيْهِ هُوَ بِالْكُفْرِ، لَكِنَّ هَذَا الَّذِي رَأَيْنَاهُ كُفْرٌ وَهُوَ مُصِرٌّ أَلَا يَكُونُ هَذَا سَبَبًا لِلْخُرُوجِ عَلَيْهِ سَوَاءٌ قُلْنَا إِنَّهُ كَافِرٌ فِي قَلْبِهِ أَوْ لَم نَقُل؟ فَأَجَابَ: ظَاهِرُ كَلَامِ كَثِيرٍ مِن أَهْلِ الْعِلْمِ أَنَّ مِثْلَ هَذَا إِذَا كَانَ فِيهِ قُوَّةٌ قَادِرَةٌ أَوْ دَوْلَةٌ قَادِرَةٌ تَسْتَطِيعُ أَن تُلْزِمَهُ وَأَن تُقَاتِلَهُ لَهُم ذَلِكَ حَتَّى يَلْتَزِمَ بِهَذَا الشَّيْءِ، لَوْ كَانَ هُنَاكَ قُوَّةٌ قَادِرَةٌ تَسْتَطِيعُ إِلْزَامَهُ بِهَذَا الشَّيْءِ: إِمَّا أَن تَلْتَزِمَ بِهَذَا الشَّيْءِ وَإِلَّا قَاتَلْنَاكَ. ذَكَرَ الشَّيْخُ تَقِيُّ الدِّينِ ابْنُ تَيْمِيَّةَ إِجْمَاعَ أَهْلِ الْعِلْمِ عَلَى هَذَا، إِذَا وُجِدَ دَوْلَةٌ لَا تَحْكُمُ الشَّرِيعَةَ أَوْ لَا تَمْنَعُ الْخَمْرَ أَوْ لَا تَمْنَعُ الرِّبَا أَوْ لَا تَمْنَعُ كَذَا أَوْ لَا تَمْنَعُ كَذَا وَجَبَ عَلَى الدَّوْلَةِ الْإِسْلَامِيَّةِ أَن تُلْزِمَهُ بِهَذَا الشَّيْءِ وَأَن تُقَاتِلَهُ إِذَا أَصَرَّت وَأَبَت وَاللَّهُ الْمُسْتَعَانُ.

فَأَجَابَ: قَرَائِنُ الْأَحْوَالِ تَقْتَضِي أَنَّهُمْ يَسْتَجِيزُونَهُ، لَكِنَّ الْحُكْمَ بِالرِّدَّةِ أَمْرٌ وَرَاءَ ذَلِكَ.
He answered: The indications of the circumstances suggest that they permit it, but the judgment of apostasy is a matter beyond that.
قَالَ السَّائِلُ: طَيِّبٌ مَسْأَلَةٌ أُخْرَى، إِذَا لَمْ نَحْكُم عَلَيْهِم بِالْكُفْرِ أَلَا يَجُوزُ أَن نَعْتَبِرَ أَنَّ هَذَا مِنَ الْكُفْرِ الَّذِي يُرَى (إِلَّا أَن تَرَوْا كُفْرًا بَوَاحًا)، وَلِذَلِكَ يَقْتَضِي الْخُرُوجَ عَلَيْهِ مَا حَكَمْنَا عَلَيْهِ هُوَ بِالْكُفْرِ، لَكِنَّ هَذَا الَّذِي رَأَيْنَاهُ كُفْرٌ وَهُوَ مُصِرٌّ أَلَا يَكُونُ هَذَا سَبَبًا لِلْخُرُوجِ عَلَيْهِ سَوَاءٌ قُلْنَا إِنَّهُ كَافِرٌ فِي قَلْبِهِ أَوْ لَم نَقُل؟
The questioner said: Alright, another issue, if we do not judge them with disbelief, is it not permissible to consider this as the disbelief that is seen (unless you see clear disbelief), and therefore it necessitates rebellion against him, what we judged him with is disbelief, but this which we saw is disbelief and he is insisting, is this not a reason for rebellion against him whether we said he is a disbeliever in his heart or we did not?
فَأَجَابَ: ظَاهِرُ كَلَامِ كَثِيرٍ مِن أَهْلِ الْعِلْمِ أَنَّ مِثْلَ هَذَا إِذَا كَانَ فِيهِ قُوَّةٌ قَادِرَةٌ أَوْ دَوْلَةٌ قَادِرَةٌ تَسْتَطِيعُ أَن تُلْزِمَهُ وَأَن تُقَاتِلَهُ لَهُم ذَلِكَ حَتَّى يَلْتَزِمَ بِهَذَا الشَّيْءِ،
He answered: The apparent speech of many of the people of knowledge is that such a thing, if there is a capable power or a capable state that can compel him and fight him, they have that right until he adheres to this thing.
