النَّاقِضُ الرَّابِعُ، فِي الْمُطَالَبَةِ وَالْمُخَاصَمَةِ، وَلِذَلِكَ لَا يَنْقَطِعُ النِّزَاعُ، وَيَدُومُ الْخِلَافُ... وَمِمَّا تَقَدَّمَ يَتَبَيَّنُ لَكَ أَيُّهَا الْمُسْلِمُ أَنَّ تَحْكِيمَ شَرْعِ اللَّهِ وَالتَّحَاكُمَ إِلَيْهِ مِمَّا أَوْجَبَهُ اللَّهُ وَرَسُولُهُ، وَأَنَّهُ مُقْتَضَى الْعُبُودِيَّةِ لِلَّهِ وَالشَّهَادَةِ بِالرِّسَالَةِ لِنَبِيِّهِ مُحَمَّدٍ، وَأَنَّ الْإِعْرَاضَ عَنْ ذَلِكَ أَوْ شَيْءٍ مِنْهُ مُوجِبٌ لِعَذَابِ اللَّهِ وَعِقَابِهِ، وَهَذَا الْأَمْرُ سَوَاءٌ بِالنِّسْبَةِ لِمَا تَعَامَلَ بِهِ الدَّوْلَةُ رَعِيَّتَهَا، أَوْ مَا يَنْبَغِي أَنْ تَدِينَ بِهِ جَمَاعَةُ الْمُسْلِمِينَ فِي كُلِّ مَكَانٍ وَزَمَانٍ، وَفِي حَالِ الِاخْتِلَافِ وَالتَّنَازُعِ الْخَاصِّ وَالْعَامِّ، سَوَاءٌ كَانَ بَيْنَ دَوْلَةٍ وَأُخْرَى أَوْ بَيْنَ جَمَاعَةٍ وَجَمَاعَةٍ، أَوْ بَيْنَ مُسْلِمٍ وَآخَرَ، الْحُكْمُ فِي ذَلِكَ كُلِّهِ سَوَاءٌ، فَاللَّهُ سُبْحَانَهُ لَهُ الْخَلْقُ وَالْأَمْرُ، وَهُوَ أَحْكَمُ الْحَاكِمِينَ، وَلَا إِيمَانَ لِمَنْ اعْتَقَدَ أَنَّ أَحْكَامَ النَّاسِ وَآرَاءَهُمْ خَيْرٌ مِنْ حُكْمِ اللَّهِ وَرَسُولِهِ، أَوْ تُمَاثِلُهُ وَتُشَابِهُهُ، أَوْ أَجَازَ أَنْ يَحُلَّ مَحَلَّهَا الْأَحْكَامُ الْوَضْعِيَّةُ وَالْأَنْظِمَةُ الْبَشَرِيَّةُ، وَإِنْ كَانَ مُعْتَقِدًا بِأَنَّ أَحْكَامَ اللَّهِ خَيْرٌ وَأَكْمَلُ وَأَعْدَلُ. وَقَالَ: «كَذَلِكَ أَشْهَدُ أَنَّ مُحَمَّدًا رَسُولُ اللَّهِ لَا تَنْفَعُ قَائِلَهَا إِذَا كَانَ لَا يُحَكِّمُ الرَّسُولَ وَلَا يَنْقَادُ لِحُكْمِهِ وَشَرْعِهِ وَلَا يُعَظِّمُ أَمْرَهُ وَنَهْيَهُ، لَا تَنْفَعُهُ هَذِهِ الشَّهَادَةُ، فَالشَّهَادَةُ إِنَّمَا تَنْفَعُ مَنْ عَمِلَ بِهَا مَنْ صَدَقَ فِي قَوْلِهَا وَوَحَّدَ اللَّهَ جَلَّ وَعَلَا وَاتَّبَعَ الشَّرِيعَةَ وَحُكْمَ رَسُولِ اللَّهِ ﷺ فِيمَا يَأْتِي وَيَذَرُ، كَمَا قَالَ: فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ. الْمَنْفِيُّ هُنَا أَصْلُ الْإِيمَانِ لَا كَمَالُهُ فَقَطْ بِدَلِيلِ مَا بَعْدَهُ. قَوْلُهُ: خَيْرٌ مِنْ حُكْمِ اللَّهِ قَالَ فِي مَوْضِعٍ آخَرَ: أَوْ أَنَّهُ أَوْلَى بِالْمُجْتَمَعِ وَأَرْفَقُ بِالْمُجْتَمَعِ مِنْ حُكْمِ اللَّهِ، أَوْ أَنَّهُ أَحْسَنُ مِنْ حُكْمِ اللَّهِ فَكُلُّ هَذَا رِدَّةٌ عَنِ الْإِسْلَامِ وَلَوْ مَا فَعَلَهُ. مَجْمُوعُ الْفَتَاوَى وَرِسَالَةُ وُجُوبِ تَحْكِيمِ شَرْعِ اللَّهِ.

وَمِمَّا تَقَدَّمَ يَتَبَيَّنُ لَكَ أَيُّهَا الْمُسْلِمُ أَنَّ تَحْكِيمَ شَرْعِ اللَّهِ وَالتَّحَاكُمَ إِلَيْهِ مِمَّا أَوْجَبَهُ اللَّهُ وَرَسُولُهُ، وَأَنَّهُ مُقْتَضَى الْعُبُودِيَّةِ لِلَّهِ وَالشَّهَادَةِ بِالرِّسَالَةِ لِنَبِيِّهِ مُحَمَّدٍ، وَأَنَّ الْإِعْرَاضَ عَنْ ذَلِكَ أَوْ شَيْءٍ مِنْهُ مُوجِبٌ لِعَذَابِ اللَّهِ وَعِقَابِهِ، وَهَذَا الْأَمْرُ سَوَاءٌ بِالنِّسْبَةِ لِمَا تَعَامَلَ بِهِ الدَّوْلَةُ رَعِيَّتَهَا، أَوْ مَا يَنْبَغِي أَنْ تَدِينَ بِهِ جَمَاعَةُ الْمُسْلِمِينَ فِي كُلِّ مَكَانٍ وَزَمَانٍ، وَفِي حَالِ الِاخْتِلَافِ وَالتَّنَازُعِ الْخَاصِّ وَالْعَامِّ، سَوَاءٌ كَانَ بَيْنَ دَوْلَةٍ وَأُخْرَى أَوْ بَيْنَ جَمَاعَةٍ وَجَمَاعَةٍ، أَوْ بَيْنَ مُسْلِمٍ وَآخَرَ، الْحُكْمُ فِي ذَلِكَ كُلِّهِ سَوَاءٌ، فَاللَّهُ سُبْحَانَهُ لَهُ الْخَلْقُ وَالْأَمْرُ، وَهُوَ أَحْكَمُ الْحَاكِمِينَ، وَلَا إِيمَانَ لِمَنْ اعْتَقَدَ أَنَّ أَحْكَامَ النَّاسِ وَآرَاءَهُمْ خَيْرٌ مِنْ حُكْمِ اللَّهِ وَرَسُولِهِ، أَوْ تُمَاثِلُهُ وَتُشَابِهُهُ، أَوْ أَجَازَ أَنْ يَحُلَّ مَحَلَّهَا الْأَحْكَامُ الْوَضْعِيَّةُ وَالْأَنْظِمَةُ الْبَشَرِيَّةُ، وَإِنْ كَانَ مُعْتَقِدًا بِأَنَّ أَحْكَامَ اللَّهِ خَيْرٌ وَأَكْمَلُ وَأَعْدَلُ.
From what has preceded, it becomes clear to you, O Muslim, that implementing the law of Allah and seeking judgment through it is among what Allah and His Messenger have made obligatory, and that it is a requirement of servitude to Allah and the testimony of the messengership of His Prophet Muhammad, and that turning away from that, or any part of it, is a cause for Allah's punishment and retribution; this matter is the same regarding how a state deals with its subjects, or what the community of Muslims should adhere to in every place and time, and in cases of private and public disagreement and conflict, whether it is between one state and another, or between one group and another, or between one Muslim and another, the ruling in all of that is the same, for Allah, glory be to Him, possesses the creation and the command, and He is the wisest of judges, and there is no faith for one who believes that the judgments and opinions of people are better than the judgment of Allah and His Messenger, or that they resemble or are similar to it, or who permits man-made laws and human systems to take their place, even if he believes that the judgments of Allah are better, more perfect, and more just.
وَقَالَ: «كَذَلِكَ أَشْهَدُ أَنَّ مُحَمَّدًا رَسُولُ اللَّهِ لَا تَنْفَعُ قَائِلَهَا إِذَا كَانَ لَا يُحَكِّمُ الرَّسُولَ وَلَا يَنْقَادُ لِحُكْمِهِ وَشَرْعِهِ وَلَا يُعَظِّمُ أَمْرَهُ وَنَهْيَهُ، لَا تَنْفَعُهُ هَذِهِ الشَّهَادَةُ، فَالشَّهَادَةُ إِنَّمَا تَنْفَعُ مَنْ عَمِلَ بِهَا مَنْ صَدَقَ فِي قَوْلِهَا وَوَحَّدَ اللَّهَ جَلَّ وَعَلَا وَاتَّبَعَ الشَّرِيعَةَ وَحُكْمَ رَسُولِ اللَّهِ ﷺ فِيمَا يَأْتِي وَيَذَرُ، كَمَا قَالَ: فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ.
He said: 'Likewise, the testimony that Muhammad is the Messenger of Allah does not benefit the one who says it if he does not seek judgment from the Messenger, does not submit to his judgment and law, and does not revere his command and prohibition; this testimony does not benefit him, for the testimony only benefits the one who acts upon it, who is truthful in saying it, who declares the oneness of Allah, the Majestic and Exalted, and who follows the Sharia and the judgment of the Messenger of Allah (peace be upon him) in what he does and leaves, as He said: "But no, by your Lord, they will not believe until they make you, [O Muhammad], judge."
