وَالْكَافِرُونَ هُمُ الظَّالِمُونَ، وَفَاسِقٌ لِقَوْلِهِ تَعَالَى: ﴿وَأَمَّا الَّذِينَ فَسَقُوا فَمَأْوَاهُمُ النَّارُ﴾، أَيْ كَفَرُوا. وَقِيلَ إِنَّهَا لِمَوْصُوفِينَ مُتَعَدِّدِينَ، وَإِنَّهَا عَلَى حَسَبِ الْحُكْمِ: فَيَكُونُ كَافِرًا فِي ثَلَاثَةِ أَحْوَالٍ: أ - إِذَا اعْتَقَدَ جَوَازَ الْحُكْمِ بِغَيْرِ مَا أَنْزَلَ اللَّهُ، بِدَلِيلِ قَوْلِهِ تَعَالَى: ﴿أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ﴾، فَكُلُّ مَا خَالَفَ حُكْمَ اللَّهِ فَهُوَ مِنْ حُكْمِ الْجَاهِلِيَّةِ، بِدَلِيلِ الْإِجْمَاعِ الْقَطْعِيِّ عَلَى أَنَّهُ لَا يَجُوزُ الْحُكْمُ بِغَيْرِ مَا أَنْزَلَ اللَّهُ، فَالْمُحِلُّ وَالْمُبِيحُ لِلْحُكْمِ بِغَيْرِ مَا أَنْزَلَ اللَّهُ مُخَالِفٌ لِإِجْمَاعِ الْمُسْلِمِينَ الْقَطْعِيِّ، وَهَذَا كَافِرٌ مُرْتَدٌّ، وَذَلِكَ كَمَنِ اعْتَقَدَ حِلَّ الزِّنَا أَوِ الْخَمْرِ أَوْ تَحْرِيمَ الْخُبْزِ أَوِ اللَّبَنِ. ب - إِذَا اعْتَقَدَ أَنَّ حُكْمَ غَيْرِ اللَّهِ مِثْلُ حُكْمِ اللَّهِ. جـ - إِذَا اعْتَقَدَ أَنَّ حُكْمَ غَيْرِ اللَّهِ أَحْسَنُ مِنْ حُكْمِ اللَّهِ، بِدَلِيلِ قَوْلِهِ تَعَالَى: ﴿وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْمًا لِقَوْمٍ يُوقِنُونَ﴾، فَتَضَمَّنَتِ الْآيَةُ أَنَّ حُكْمَ اللَّهِ أَحْسَنُ الْأَحْكَامِ بِدَلِيلِ قَوْلِهِ تَعَالَى مُقَرِّرًا ذَلِكَ: ﴿أَلَيْسَ اللَّهُ بِأَحْكَمِ الْحَاكِمِينَ﴾، فَإِذَا كَانَ اللَّهُ أَحْسَنَ الْحَاكِمِينَ أَحْكَامًا وَهُوَ أَحْكَمُ الْحَاكِمِينَ فَمَنِ ادَّعَى أَنَّ حُكْمَ غَيْرِ اللَّهِ مِثْلُ حُكْمِ اللَّهِ أَوْ أَحْسَنُ الْأَحْكَامِ فَهُوَ كَافِرٌ؛ لِأَنَّهُ مُكَذِّبٌ لِلْقُرْآنِ.

Line-by-line translation · المعاني

وَالْكَافِرُونَ هُمُ الظَّالِمُونَ، وَفَاسِقٌ لِقَوْلِهِ تَعَالَى: ﴿وَأَمَّا الَّذِينَ فَسَقُوا فَمَأْوَاهُمُ النَّارُ﴾، أَيْ كَفَرُوا.
And the disbelievers are the wrongdoers, and [they are] defiantly disobedient (fasiq) due to His saying, the Exalted: 'But as for those who defiantly disobeyed, their refuge is the Fire,' meaning they disbelieved.
وَقِيلَ إِنَّهَا لِمَوْصُوفِينَ مُتَعَدِّدِينَ، وَإِنَّهَا عَلَى حَسَبِ الْحُكْمِ: فَيَكُونُ كَافِرًا فِي ثَلَاثَةِ أَحْوَالٍ:
It has been said that it refers to multiple descriptions, and that it depends on the ruling; thus, one is a disbeliever in three cases:
أ - إِذَا اعْتَقَدَ جَوَازَ الْحُكْمِ بِغَيْرِ مَا أَنْزَلَ اللَّهُ، بِدَلِيلِ قَوْلِهِ تَعَالَى: ﴿أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ﴾، فَكُلُّ مَا خَالَفَ حُكْمَ اللَّهِ فَهُوَ مِنْ حُكْمِ الْجَاهِلِيَّةِ، بِدَلِيلِ الْإِجْمَاعِ الْقَطْعِيِّ عَلَى أَنَّهُ لَا يَجُوزُ الْحُكْمُ بِغَيْرِ مَا أَنْزَلَ اللَّهُ، فَالْمُحِلُّ وَالْمُبِيحُ لِلْحُكْمِ بِغَيْرِ مَا أَنْزَلَ اللَّهُ مُخَالِفٌ لِإِجْمَاعِ الْمُسْلِمِينَ الْقَطْعِيِّ، وَهَذَا كَافِرٌ مُرْتَدٌّ، وَذَلِكَ كَمَنِ اعْتَقَدَ حِلَّ الزِّنَا أَوِ الْخَمْرِ أَوْ تَحْرِيمَ الْخُبْزِ أَوِ اللَّبَنِ.
A - If he believes in the permissibility of ruling by other than what Allah has revealed, based on the evidence of His saying, the Exalted: 'Then is it the judgment of [the time of] ignorance they desire?' For everything that contradicts the judgment of Allah is from the judgment of ignorance, based on the definitive consensus that it is not permissible to rule by other than what Allah has revealed; therefore, the one who permits and legalizes ruling by other than what Allah has revealed contradicts the definitive consensus of the Muslims, and this person is an apostate disbeliever, just like one who believes in the lawfulness of adultery or alcohol, or the prohibition of bread or milk.
