بَابُ تَغْلِيظِ تَحْرِيمِ إِبَاقِ الْعَبْدِ مِنْ سَيِّدِهِ. الثَّالِثَةُ: أَنَّهُ لا تُقْبَلُ صَلاتُهُ، فَالْعَبْدُ إِذَا أَبَقَ وَهَرَبَ مِنْ سَيِّدِهِ، ثُمَّ صَلَّى، فَلا صَلاةَ لَهُ، وَاخْتَلَفَ الْعُلَمَاءُ رَحِمَهُمُ اللَّهُ: هَلْ صَلاتُهُ غَيْرُ مَقْبُولَةٍ لا الْفَرِيضَةُ وَلا النَّافِلَةُ؟ أَوْ أَنَّهَا النَّافِلَةُ فَقَطْ؟ فَمِنَ الْعُلَمَاءِ مَنْ قَالَ: صَلاةُ الْفَرِيضَةِ مَقْبُولَةٌ؛ لأَنَّ زَمَنَهَا مُسْتَثْنًى شَرْعًا، وَلأَنَّهُ سَوْفَ يُصَلِّي، سَوَاءً كَانَ عِنْدَ سَيِّدِهِ أَوْ آبِقًا مِنْهُ، وَمِنْهُمْ مَنْ قَالَ: إِنَّهُ حَدِيثٌ عَامٌّ وَلا يَمْتَنِعُ أَنْ يُعَاقَبَ بِذَلِكَ، وَيَكُونُ الْمُرَادُ بِنَفْيِ الْقَبُولِ بِالنِّسْبَةِ لِلنَّوَافِلِ نَفْيَ الصِّحَّةِ، وَبِالنِّسْبَةِ لِلْفَرَائِضِ نَفْيَ الإِثَابَةِ، وَهَذَا جَمْعٌ حَسَنٌ. وَاللَّهُ أَعْلَمُ.

الثَّالِثَةُ: أَنَّهُ لا تُقْبَلُ صَلاتُهُ، فَالْعَبْدُ إِذَا أَبَقَ وَهَرَبَ مِنْ سَيِّدِهِ، ثُمَّ صَلَّى، فَلا صَلاةَ لَهُ،
The third point is that his prayers are not accepted; if a slave runs away from his master and then prays, his prayer does not count.
وَاخْتَلَفَ الْعُلَمَاءُ رَحِمَهُمُ اللَّهُ: هَلْ صَلاتُهُ غَيْرُ مَقْبُولَةٍ لا الْفَرِيضَةُ وَلا النَّافِلَةُ؟ أَوْ أَنَّهَا النَّافِلَةُ فَقَطْ؟
Scholars—may Allah have mercy on them—differed on whether this rejection applies to both obligatory and voluntary prayers, or only to the voluntary ones.
