بَابُ تَحْرِيمِ مَطْلِ الْغَنِيِّ بِحَقٍّ طَلَبَهُ صَاحِبُهُ. فَذَهَبَ الْحَنَابِلَةُ رَحِمَهُمُ اللهُ إِلَى أَنَّ هَذَا عَلَى سَبِيلِ الْوُجُوبِ، وَأَنَّهُ يَجِبُ عَلَى الطَّالِبِ أَنْ يَتَحَوَّلَ إِذَا حُوِّلَ عَلَى إِنْسَانٍ مَلِيءٍ. وَقَالَ أَكْثَرُ الْعُلَمَاءِ: إِنَّهُ عَلَى سَبِيلِ الِاسْتِحْبَابِ؛ لِأَنَّ الْإِنْسَانَ لَا يَلْزَمُهُ أَنْ يَتَحَوَّلَ، قَدْ يَقُولُ: صَاحِبِي الْأَوَّلُ أَهْوَنُ وَأَيْسَرُ، وَأَمَّا الثَّانِي فَأَهَابُهُ وَأَخَافُ مِنْهُ وَمَا أَشْبَهَ ذَلِكَ، لَكِنْ لَا شَكَّ أَنَّ الْأَفْضَلَ أَنْ يَتَحَوَّلَ إِلَّا لِمَانِعٍ شَرْعِيٍّ. وَاللهُ الْمُوَفِّقُ.

Chapter: The prohibition of a wealthy person delaying the payment of a debt owed to a claimant.
فَذَهَبَ الْحَنَابِلَةُ رَحِمَهُمُ اللهُ إِلَى أَنَّ هَذَا عَلَى سَبِيلِ الْوُجُوبِ،
The Hanbali scholars, may Allah have mercy on them, maintained that this is an obligation.
وَأَنَّهُ يَجِبُ عَلَى الطَّالِبِ أَنْ يَتَحَوَّلَ إِذَا حُوِّلَ عَلَى إِنْسَانٍ مَلِيءٍ.
The claimant is required to accept the transfer of debt if referred to a solvent individual.
