٨٣- بَابُ النَّهْيِ عَنْ تَوْلِيَةِ الْإِمَارَةِ وَالْقَضَاءِ وَغَيْرِهِمَا مِنَ الْوِلَايَاتِ لِمَنْ سَأَلَهَا -٨٣ - بَابُ النَّهْيِ عَنِ تَولِيَةِ الْإِمَارَةِ وَالْقَضَاءِ وَغَيْرِهِمَا مِنَ الْوِلَايَاتِ لِمَنْ سَأَلَهَا أَوْ حَرَصَ عَلَيْهَا؛ فَعَرَّضَ بِهَا ٦٧٩ - عَنْ أَبِي مُوسَى الْأَشْعَرِيِّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: دَخَلْتُ عَلَى النَّبِيِّ ﷺ أَنَا وَرَجُلَانِ مِنْ بَنِي عَمِّي، فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللَّهِ، أَمِّرْنَا عَلَى بَعْضٍ مَا وَلَّاكَ اللَّهُ عَزَّ وَجَلَّ، وَقَالَ الْآخَرُ مِثْلَ ذَلِكَ، فَقَالَ: «إِنَّا وَاللَّهِ - لَا نُوَلِّي هَذَا الْعَمَلَ أَحَدًا سَأَلَهُ، أَوْ أَحَدًا حَرَصَ عَلَيْهِ، مُتَّفَقٌ عَلَيْهِ ) . الشَّرْحُ هَذَا الْبَابُ الَّذِي ذَكَرَهُ الْمُؤَلِّفُ الْحَافِظُ النَّوَوِيُّ رَحِمَهُ اللَّهُ: بَابُ النَّهْيِ عَنْ تَوْلِيَةِ الْإِمَارَةِ وَالْقَضَاءِ وَغَيْرِهِمَا مِنَ الْوِلَايَاتِ لِمَنْ سَأَلَهَا أَوْ حَرَصَ عَلَيْهَا؛ فَعَرَّضَ بِهَا»، وَقَدْ سَبَقَ فِي حَدِيثِ عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ قَالَ: «لَا تَسْأَلِ الْإِمَارَةَ؛ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا، وَإِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا (٢). كَذَلِكَ - أَيْضًا - لَا يَنْبَغِي لِوَلِيِّ الْأَمْرِ إِذَا سَأَلَهُ أَحَدٌ أَنْ يُؤَمِّرَهُ عَلَى بَلَدٍ، أَوْ عَلَى قِطْعَةٍ مِنَ الْأَرْضِ فِيهَا بَادِيَةٌ، أَوْ مَا أَشْبَهَ ذَلِكَ، حَتَّى وَإِنْ كَانَ الطَّالِبُ أَهْلًا لِذَلِكَ؛ (١) أَخْرَجَهُ الْبُخَارِيُّ كِتَابُ الْأَحْكَامِ، بَابُ مَا يُكْرَهُ مِنَ الْحِرْصِ عَلَى الْإِمَارَةِ، رَقْمُ (٧١٤٩)، وَمُسْلِمٌ كِتَابُ الْإِمَارَةِ، بَابُ النَّهْيِ عَنْ طَلَبِ الْإِمَارَةِ وَالْحِرْصِ عَلَيْهَا، رَقْمُ (١٤/١٧٣٣). 83. Chapter: Prohibition against appointing those who request positions of leadership, judiciary, or other offices.
بَابُ النَّهْيِ عَنِ تَولِيَةِ الْإِمَارَةِ وَالْقَضَاءِ وَغَيْرِهِمَا مِنَ الْوِلَايَاتِ لِمَنْ سَأَلَهَا أَوْ حَرَصَ عَلَيْهَا؛ فَعَرَّضَ بِهَا ٦٧٩ -
83. Chapter: Prohibition against appointing those who request, covet, or hint at wanting positions of leadership, judiciary, or other offices.
عَنْ أَبِي مُوسَى الْأَشْعَرِيِّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: دَخَلْتُ عَلَى النَّبِيِّ ﷺ أَنَا وَرَجُلَانِ مِنْ بَنِي عَمِّي، فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللَّهِ، أَمِّرْنَا عَلَى بَعْضٍ مَا وَلَّاكَ اللَّهُ عَزَّ وَجَلَّ، وَقَالَ الْآخَرُ مِثْلَ ذَلِكَ، فَقَالَ: «إِنَّا وَاللَّهِ - لَا نُوَلِّي هَذَا الْعَمَلَ أَحَدًا سَأَلَهُ، أَوْ أَحَدًا حَرَصَ عَلَيْهِ، مُتَّفَقٌ عَلَيْهِ ) . الشَّرْحُ
679. Abu Musa al-Ash'ari (may Allah be pleased with him) reported: I visited the Prophet (peace be upon him) with two of my cousins. One of them said, "Messenger of Allah, appoint us to some of the positions Allah has entrusted to you." The other made the same request. The Prophet replied, "By Allah, we do not appoint anyone to these positions who asks for them or covets them." (Agreed upon).

Commentary:
هَذَا الْبَابُ الَّذِي ذَكَرَهُ الْمُؤَلِّفُ الْحَافِظُ النَّوَوِيُّ رَحِمَهُ اللَّهُ: بَابُ النَّهْيِ عَنْ تَوْلِيَةِ الْإِمَارَةِ وَالْقَضَاءِ وَغَيْرِهِمَا مِنَ الْوِلَايَاتِ لِمَنْ سَأَلَهَا أَوْ حَرَصَ عَلَيْهَا؛ فَعَرَّضَ بِهَا»، وَقَدْ سَبَقَ فِي حَدِيثِ عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ قَالَ: «لَا تَسْأَلِ الْإِمَارَةَ؛ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا، وَإِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا (٢).
The author, Hafiz al-Nawawi (may Allah have mercy on him), titled this chapter: "Prohibition against appointing those who request, covet, or hint at wanting positions of leadership, judiciary, or other offices." As noted in the hadith of Abd al-Rahman ibn Samurah (may Allah be pleased with him), the Prophet said, "Do not ask for leadership. If you are given it without asking, you will be helped in it; if you are given it because you asked, you will be left to manage it alone."
كَذَلِكَ - أَيْضًا - لَا يَنْبَغِي لِوَلِيِّ الْأَمْرِ إِذَا سَأَلَهُ أَحَدٌ أَنْ يُؤَمِّرَهُ عَلَى بَلَدٍ، أَوْ عَلَى قِطْعَةٍ مِنَ الْأَرْضِ فِيهَا بَادِيَةٌ، أَوْ مَا أَشْبَهَ ذَلِكَ، حَتَّى وَإِنْ كَانَ الطَّالِبُ أَهْلًا لِذَلِكَ؛ (١)
Likewise, a ruler should not grant a position over a city, a rural territory, or anything similar to anyone who requests it, even if the applicant is qualified.

It was narrated by Al-Bukhari in the Book of Rulings, Chapter: Whoever does not ask for leadership, Allah will help him with it, Hadith No. (7146), and by Muslim in the Book of Oaths, Chapter: It is recommended for one who takes an oath and then sees something better than it, Hadith No. (1650), from the explanation of Riyad al-Salihin from the words of the Master of Messengers, may Allah bless him and grant him peace. ⟶ (sentence continues on next page)
